New guidance for instructors using fair dealing in creating or adapting OER

The SFU Copyright Office supports the use of fair dealing where appropriate in creating and adapting open educational resources (OER), and endorses the new Code of Best Practices in Fair Dealing for Open Educational Resources: A Guide for Authors, Adapters & Adopters of Openly Licensed Teaching and Learning Materials in Canada from the Canadian Association of Research Libraries. The Code provides a detailed exploration of how fair dealing might apply in the context of creating and adapting OER, including a series of case studies of common uses of inserted content in teaching materials.

Our new resource Using fair dealing in creating and adapting Open Educational Resources (OER) provides additional context and explores challenges that arise when incorporating material in an OER under fair dealing.

The Copyright Office welcomes any questions and requests for consultation from instructors creating or adapting OER. Contact us at copy@sfu.ca.
